ACS has written to the Magistrates Association in response to their statement this week that Fixed Penalty Notices (FPNs) for shop theft are being inappropriately used. ACS has successfully campaigned for better guidance on the use of FPNs, and earlier this year met with Justice Secretary Jack Straw to discuss this issue.

ACS Chief Executive James Lowman said: “The Magistrates Association is voicing concern felt by many retailers who are sceptical about the impact FPNs have had on deterring shop theft and who are alarmed at their inconsistent application.

“We believe that new Guidance will prevent the majority of instances of inappropriate ticketing, though we will monitor this situation closely. I know that Jack Straw shares our view that shop theft is not a victimless crime. Now we need to see effective use of FPNs and other sanctions to ensure that shop thieves are deterred and that victims are properly supported.”
