Proposal for Positive Licensing of Tobacco in Scotland

Christine Grahame, Member of Scottish Parliament (MSP), has laid a Members Bill before Scottish Parliament proposing a licensing system for the sale of tobacco.

The proposal calls for positive licensing to be introduced in Scotland, meaning that retailers would have to apply for a license to sell tobacco, as they currently do for the sale of alcohol. The Bill also looks at increasing the penalties on retailers who sell to those underage.

Supported by Ash Scotland, Cancer Research UK, British Medical Association Scotland, and British Heart Foundation Scotland, Grahame believes the Bill is the only way that retailers will enforce the law and stop selling to those underage. While the proposal aims not to add to cost and bureaucracy, ACS will be responding to the consultation to ensure that the voice of the small retailer is heard.

The consultation response will inform the Scottish Government, which is publishing a new strategy on smoking prevention next year.

The deadline for response is 15th January 2008.
