Police Powers to Object to a DPS
All DPS' must hold a personal licence, to get a personal licence you have to undergo a Criminal Records Bureau check.
However the Police have additional powers to raise objections to a particular individual being in charge of alcohol sales from a premises. They have to justify their reasons for this to the local authority. An example would be a person with a history of involvement in drugs, running a premises that has a known drug problem.
If the police have an objection that must raise it within the consultation period for new applications, or within 14 days of the applicant notifying the Local Authority of a change in designated premises supervisor.
It is important to remember that the Government’s Guidance on this point stresses that this power to object should only be employed in exceptional circumstances.
